Las Tunas.- In accordance with the International Convention on the Rights of the Child, the New Cuban Penal Code protects minors, through their own procedural prerogatives.

The Law professor of the University of Las Tunas, Irenia Diez explained that this regulation maintains 16 years as the age limit for criminal responsibility pre-established in the previous code, but makes a reservation with a differentiated treatment between 16 and 18 years of age. , which is what is provided for under international conventions.

However, guarantees are offered up to the age of 18, in accordance with Law 143 of Criminal Procedure, which also authorizes the acting prosecutors, in accordance with the criteria of opportunity, to decide the situation of the defendants.

She clarified that minors in situations of criminal conflict will only be subjected to legal proceedings for serious crimes such as terrorism, drug trafficking, those perpetrated against the internal and external security of the State, and those that threaten life, among others.

The new criminal code, in force since the end of 2022, also admits the reduction of the minimum and maximum limits of the sentence, even for young people up to 20 years of age.
